Abstract

Bankruptcy is a method of executing the assets of a commercial debtor due to his failure to pay his commercial debts in order to strengthen credit and support confidence in commercial transactions. Bankruptcy affects the debtor’s exercise of his financial and non-financial rights (civil and political) in most Iraqi and Arab laws, even if the debtor is acting in good faith, with the exception of some laws that give the bankrupt debtor the freedom to exercise some rights that help him regain his financial activity again, while his non-financial rights are not affected by bankruptcy, such as American law. In our research, we aim to examine this issue by analyzing and comparing how Arab and American legal systems address the bankrupt debtor's ability to exercise both financial and non-financial rights.
