Victims’ Right in Compensation in Accordance with Islamic law and the International Criminal Court

Protecting the rights of crime victims is not a new topic for experts in applying the rules of criminal law, just as the law is not new after these rules exist and human society understands them in the form of custom, tradition, or written rules. Specialists did not address it; it is more appropriate to say that it is an old and new topic, as it is as old as the first human society, because the victim has an absolute right to punish the criminal or pardon him. This is not relevant to the topic “To what the first human societies took tribal forms”, but they continued to exist for most of human history even after these societies took the form of a state and organized criminal procedures with the aim of punishing criminals. Historically, crime and punishment experts have focused on affirming the rights of crime victims and promoting their fulfillment, while the offender is considered an enemy of society and therefore does not receive the attention and care of these experts.
There is no doubt that the importance of crime is still increasing in the in the less developed world, as the damage caused by crime is more serious and more effective than in developed countries, where wealth and high standards of living can absorb much of the damage caused by their crimes.
This research aims to reveal in front of the International Criminal Court.
To achieve the aim of the research, the researcher identified the basic elements of the research in the first section which are: the research problem, its importance, its objectives, and defining its terminology. As for the second section, it dealt with the victims’ rights in compensation according to Islamic law and the International Criminal Court. It ended with a conclusion that includes the results and recommendations of the research.
