مستخلص البحث:
تعتبر مسألة الحقوق الأساسية من القضايا المركزية الجديرة بالدراسة المتعمقة والشاملة ، حيث أن هذه الحقوق هي المقياس الحقيقي لدرجة ديمقراطية النظام السياسي ، فهي تعبر عن الواجهة الحقيقية للنظام وكيف تتعلق بالحرية والمساواة والمشاركة في الحياة السياسية ، ودرجة توافق المثل الديمقراطية أو عدم تناسقها. لا حرية بدون عدالة ، ولا عدالة بدون مشاركة ، ولا مشاركة بدون حرية ، لأن الاستبداد السياسي هو السبب الرئيسي لتقليص أو غياب الحقوق والحريات الأساسية للفرد. دوليًا ودستوريًا ، للأفراد الحق في الحياة السياسية.
والحقوق المدنية والسياسية هي حقوق أساسية تعترف بها معظم الدساتير حول العالم ، ويضيق نطاقها أو يتوسع وفقًا لنسبة الديمقراطية أو هيمنة النظام. من حيث السيادة الشعبية ، لا تقتصر الدولة على إدراج النصوص المتعلقة بالحقوق المدنية والسياسية في دستورها ، بل تسعى جاهدة إلى وضع ضمانات لممارسة الحقوق المدنية والسياسية ، وضمانات تمنع إهدار هذه الحقوق قدر الإمكان
وقد هدف البحث الى الكشف عن معرفة مفهوم الحقوق والحريات وكذلك كفالة الحقوق والحريات المتعلقة بالذات الانسانية .
ولتحقيق البحث حددت الباحث في المبحث الاول العناصر الاساسية للبحث وهي مشكلة البحث واهميته واهدافه وتحديد المصطلحات الخاصة به واما المبحث الثاني فقد تناول كفالة الحقوق والحريات الانسانية وختم البحث بخاتمة تضمنت النتائج والتوصيات الخاصة بالبحث
